D-8 Preferential Trade Agreement: Rules of Origin and Customs Duties

This Order [P.U. (A) 291/2023 gazetted on 29 September 2023] pertains to the Customs Duties regulations under the Preferential Trade Agreement (PTA) among the D-8 Member States.


In this Order—


Contracting Member” means any state which is a party to the Prefential Trade Agreement among the D-8 Member States;


D-8 Member States” means the countries of Bangladesh, Indonesia, Iran, Malaysia, Egypt, Nigeria, Pakistan and Turkiye; and


Preferential Trade Agreement” means an agreement among D-8 Member States signed at Bali, Indonesia on 13 May 2006.

It includes:

  • Rules and Criteria: It sets forth the rules and criteria for determining the origin of products to establish eligibility for preferential treatment under the agreement.

  • Preferential Treatment: It specifies the import duties for goods originating from certain member states, aiming to facilitate trade by offering reduced tariffs.

  • Definitions and Interpretations: The Order provides definitions and interpretations of terms used within the agreement.

  • Revocation of Previous Order: It revokes a prior Customs Duties Order from 2013, indicating an update or change in the regulations.

  • Certificates of Origin: It outlines the procedures for obtaining a D-8 Certificate of Origin, which is necessary for exporters to benefit from the preferential treatment. This includes issuance, validity, submission, verification, and provisions for retrospective issuance and duplicates.

  • Operational Certification Procedures: The Order details the operational certification procedures for the issuance of D-8 Certificates of Origin.

  • Dispute Settlement and Penalties: It covers dispute settlement mechanisms and penalties for providing incorrect information.

  • Goods in Transit and Storage: It includes procedures for goods that are in transit or storage.

  • Free Zones and Indirect Materials: The Order addresses rules for free zones and the treatment of indirect materials.

  • Review and Modification: It allows for the review and modification of the rules.

  • Import Duty Rates: It provides a detailed list of import duty rates for a wide range of goods, including but not limited to rubber, wood, leather, household appliances, electrical machinery, and various other products. The rates vary from 0% to 25% based on the item and its classification.

  • Verification Guidelines: Instructions and guidelines for the verification of certificates of origin are included.

  • Abbreviations and Symbols: The Order lists abbreviations and symbols used for ease of reference.
